现行《公务员法》及相关法规、规章关于公务员兼职的规定存在着公务员可以兼职的条件不明、可以兼职的范围不明、有权批准的机关不明、批准的具体程序不明等问题,致使在现实适用中歧义丛生,难以执行。公务员兼职屡禁不止,除了规定本身存在的问题外,还有对兼职公务员处罚力度不够以及公权力缺乏有效制约等原因,应当制定公务员兼职实施细则,加大对公务员违规兼职处罚力度,尽早出台公务员财产申报制度,方能减弱公务员违规兼职的欲望,进而减少公务员违规兼职的数量。
