豁免问题在国际法上由来已久,可以说自从有了国际法,就有了豁免制度。欧洲三十年战争结束之后,国家主权和主权平等原则发展起来,成为近代国际法最根本的原则和基础,国际法上的国家豁免问题由此产生。尽管国家豁免问题在现代国际社会存在着不同的理论和实践,但国家及其财产豁免已经成为现代国际法上的一项重要原则。本文尝试从辩证的角度质疑和剖析当前国家豁免的两种主要理论,并探讨今后我国在此问题上应持有的立场。
The question of immunity has a long history in international law. It can be said that there has been a system of immunity since international law existed. After the end of the European 30 years’ war, the principle of equality between state sovereignty and sovereignty has developed and become the most fundamental principle and basis of modern international law. The issue of state immunity in international law thus arises. Although the issue of state immunity exists in different theories and practices in the modern international community, the state and its property exemptions have become an important principle in modern international law. This article attempts to question and analyze the two main theories of current state immunity from a dialectical point of view and to explore the position China should hold on this issue in the future.
