根据现实中企业普遍存在的新旧劳资问题,重点对管理学意义上的惩罚原理的不足以及用人单位处罚劳动者存在的问题进行剖析,针对现实中劳动关系管理中新的亟待规范的问题,突破了传统处罚性管理思维,运用劳动法和企业管理实务的双重视角,提出了相对可行的劳资关系新思路和新方案,并且从相反的视角论证了沉重的惩罚理念应当淡出日新月异的劳动关系格局的命题。
According to the common problems of the old and the new labor-capital in the enterprises, the author mainly analyzes the inadequacy of the punitive principle in the sense of management and the problems that the employing units punish the laborers. In view of the new problems that need to be standardized in the labor relation management, Traditional punitive management thinking, the use of labor law and business management practices of dual perspective, put forward a relatively feasible new ideas and new programs of labor relations, and from the opposite perspective demonstrated that the concept of heavy punishment should fade out rapidly changing labor relations proposition .
