在我国走向现代化的过程中,对环境的严重污染与破坏日益突出,环境保护被提到了前所未有的高度,仅有民事手段和行政处罚手段是不够的。理论与实务也日益重视刑法在保护环境中的作用。在环境犯罪立法这个领域,我们所确立的制度并非十全十美,还需要进一步探讨和完善。必须在环境犯罪的立法上有所突破,这必将是大势所趋。 In the course of our country’s modernization, the serious pollution and destruction to the environment have become increasingly prominent. Environmental protection has been mentioned to an unprecedented height. Merely civil means and administrative sanctions are not enough. Theory and Practice have also paid increasing attention to the role of criminal law in protecting the environment. In the field of environmental crime legislation, the system we have established is not perfect and needs to be further explored and improved. We must make a breakthrough in the legislation on environmental crime, which will certainly be the trend of the times.
