保护消费者利益是商标立法中调整商标关系的一项基本准则,它也表现在商标法和实务中都不能损害消费者利益。商标立法中保护消费者利益的原则反映了我国社会主义的生产目的。我国的消费者是各行各业的劳动者,失去了消费者和消费需求,一切生产经营活动将会失去动力,商品销售无从谈起。因此,我国商标立法十分重视保护消费者利益。本文即拟对商标法保护消费者利益关系问题进行探讨,希望对商标法理论研究有所裨益。
Protecting the interests of consumers is a basic guideline for adjusting trademark relations in trademark legislation. It also shows that neither the trademark law nor the practice can harm consumers’ interests. The principle of protecting the interests of consumers in trademark legislation reflects the purpose of socialist production in our country. Consumers in our country are laborers of all walks of life, have lost consumers and consumer demand, all their production and management activities will lose their motivation, and their sales of commodities can not be discussed. Therefore, our trademark legislation attaches great importance to protecting the interests of consumers. This article intends to discuss the protection of the interests of consumers in the Trademark Law, and hopes to study the theory of trademark law.
