基本案情束某,某市某镇三城村党支部书记。许某,某市红太阳服饰有限公司法定代表人,中共党员。某市红太阳服饰有限公司(以下简称“红太阳公司”)向当地政府和有关部门申请征用三城村城西村民小组的土地,并于2003年8月5日与城西村民小组签订“土地征用补偿协议”。根据协议:红太阳公司拟申请征地4.25亩,土地补偿费按12000元每亩,共计51000元,青苗补偿费按300元每亩,共计1275元,合计52275元。2003年12月1日,红太阳公司交给某市国土所各项费用122560元,准备办理土地征用手续,但因故未获批准。2005年7月,该公司的征地被批准,但因国家土地征用补偿费用标准提高,许某按政策规定将提高的土地征用补偿费用共计110720元,随同其他费用一并交人国土部门,后国土部门与劳动保障部门按政策规定将该笔土地征用补偿费用汇至三
