计算机、网络相关犯罪给现有刑事证据调查制度提出了新的问题 ,计算机数据实时收集措施是有效侦破这类犯罪的利器 ,但其相关权利保障问题也引起了社会的高度重视。有些国家的通信监听法与计算机数据实时收集措施相似 ,相关成功的立法经验值得计算机数据实时收集立法加以借鉴。欧洲理事会《关于网络犯罪的公约》规定了计算机数据实时收集措施的基本内容。本文比较国外相关立法 ,对在我国刑事程序法中设立计算机数据实时收集措施提出了建议。
Computer-related and cyber-related crimes have brought new problems to the existing system of investigation of criminal evidence. The real-time collection of computer data is an effective weapon to detect such crimes. However, the protection of related rights has drawn great attention from the society. In some countries, the interception of communications law is similar to the real-time collection of computer data. Relevant successful legislative experience deserves to be borrowed from real-time collection of computer data by legislation. The Council of Europe Convention on Cybercrime provides the basic elements of a real-time collection of computer data. This article compares the relevant foreign legislation and puts forward some suggestions on how to set up the real-time collection of computer data in China’s Criminal Procedural Law.
