截至2008年11月底,我国网民数量达到2.9亿,网民规模位居世界第一。与整个网络产业的发展相伴的是,在线网络电子商务交易纠纷也迅速增加。由于交易网络是处于一个网络电子虚拟空间中,这一特有属性便带来了一系列问题。交易双方缺乏诚信、网上诈骗、欺客、以次充好、交易安全等问题成为电子商务发展的一个瓶颈,交易当事人的权益缺乏足够保障。因此依法治网,将电子商务发展纳入法制轨道是治理在线网络交易秩序的重要基础,电子商务合同立法成为必需。本文通过对电子商务合同的相关内容进行阐述,针对电子商务合同立法现状及其局限性,从而提出电子商务合同立法的可行性,并在此基础上提出相关完善的建议。
As of the end of November 2008, the number of Internet users in our country reached 290 million with the largest Internet users in the world. Accompanying the development of the entire network industry is the rapid increase of online e-commerce transaction disputes. Due to the trading network is in a network of electronic virtual space, this unique property has brought a series of problems. Lack of integrity of both parties to the transaction, online fraud, bullying, shoddy, transaction security and other issues become a bottleneck in the development of e-commerce, transaction rights and interests of the parties lack of adequate protection. Therefore, the rule of law according to the law, the development of e-commerce into the legal track is an important basis for the governance of online trading order, e-commerce contract legislation has become necessary. This essay elaborates the relevant contents of e-commerce contracts, and proposes the feasibility of legislation on e-commerce contracts based on the status quo and limitations of e-commerce legislation.
