根本违约制度作为一项关系到合同存在的重要制度,在市场交易活动中发挥着不可估量的作用,如果不能合理恰当的利用该制度,势必会影响交易的顺利进行,甚至影响整个社会经济的发展。本文指出我们需要在对该制度有正确了解的基础上,分析根本违约的含义、构成和效果,以期深入的探讨根本违约制度,更好的指导实践。
As an important system that affects the existence of a contract, the system of fundamental breach of contract plays an invaluable role in the market transaction. If the system can not be reasonably and properly utilized, it will inevitably affect the smooth progress of the transaction and even affect the development of the entire society and economy . This article points out that we need to have a correct understanding of the system, based on the analysis of the meaning, structure and effect of fundamental breach of contract, with a view to in-depth exploration of the fundamental breach of contract system, and better guide practice.
