近年来“代孕”问题成为人们关注的热点。由于法律的规定较为简单,代孕作为一种相对新兴的事物,给伦理道德和法律监管都带来一系列新的挑战。文章结合一起由代孕引发的抚养权争夺案,从法学角度对该案的审理过程及判决结果进行利益衡量方法的分析,为司法实践提供参考。
In recent years, “surrogate ” issue has become a hot spot for people’s attention. As the legal provisions are relatively simple, surrogacy as a relatively new thing, to the ethics and legal supervision have brought a series of new challenges. This article combines the case of escorting for custody caused by surrogacy, analyzes the process of adjudication of the case and the method of benefit measurement from the angle of jurisprudence, and provides a reference for judicial practice.
