笔者长期密切关注民法总则的立法进程及各阶段的草案及征求意见稿,并有幸受山东省律师协会的指派参加了山东省人大法工委二审稿征求意见座谈会并提出了修改建议。现将笔者对二审稿的修改建议进行整理,以求教于律师同仁和专家学者。一、是“基本原则”还是“一般规定”或“通则”二审稿第一章为基本原则。笔者认为,该章名称修改为“一般规定”或“通则”更为准确。
The author has paid close attention to the legislative process of the General Rules of Civil Law and the drafts and draft for soliciting opinions at various stages for a long period of time. Fortunately, it was fortunate that the Shandong Provincial Bar Association has participated in the symposium for soliciting comments of the Second People’s Congress of Shandong Provincial People’s Law Commission and proposed amendments. Now the author of the second review of the proposed amendments to order to seek advice in lawyers colleagues and experts and scholars. First, it is the “basic principle” or “the general rule” or the “general rule”. The first chapter of the second review is the basic principle. In my opinion, the title of the chapter is amended as “General Provisions” or “General Rules” more accurately.
