目的:卫生行政执法规避风险,提高依法行政水平。方法:从法律依据和法理上分析。结果:涉嫌非法行医罪的不可先处罚再移送。结论:建议在非法行医司法解释出台后应加强和司法部门的沟通,从而及时、有效地惩处非法行医。
Objective: Health administrative law enforcement to avoid risks and improve the level of administration according to law. Methods: From the legal basis and legal analysis. Results: The crime of suspected illegal medical practice can not be punished and then transferred. Conclusion: It is suggested that after judicial interpretation of illegal medical practice, the communication with the judicial department should be strengthened so that illegal medical practice can be promptly and effectively punished.
