本公约第七条反映了一项建立统一法的国际公约所起的特殊而又困难的作用。该条第(1)款强调解释这部法律必须敏锐地注意到它的特殊性质和目的;第(2)款旨在帮助这部法律能适用于新的情况,并依据新的情况得以发展。第七条:(1)在解释本公约时,应考虑到本公约的国际性质和促进其适用的统一以及在国际贸易上遵守诚信的需要。 (2)凡本公约未明确解决的属于本公约范围的问题,应按照本公约所依据的一般原则来解决,在没有一般原则的情况下,则应按照国际私法规则所指定的适用法律予以解决。
Article VII of this Convention reflects the special and difficult role played by an international convention establishing a uniform law. Paragraph (1) of the article emphasizes that the interpretation of this law must be acutely aware of its particular nature and purpose; paragraph (2) is intended to help make the law applicable to new situations and to be developed on new circumstances. Article 7: (1) In interpreting this Convention, account shall be taken of the international character of this Convention and the promotion of its uniform application as well as the need to observe good faith in international trade. (2) Any question falling within the ambit of this Convention which is not expressly settled by this Convention shall be dealt with in accordance with the general principles on which the present Convention is based, and in the absence of general principles, shall be settled in accordance with the applicable law as specified in the rules of private international law .
