我国最早录全十二律名的文献是《国语》,书中所录十二律名不但完整保留到今天,还得到律学界公认,律学著作至今仍沿用此十二个名称。但这传统十二律名不是一次成形于《国语》所载之时。乐官伶州鸠是借助对六律的释说表达“敬天保民”思想,以六吕的释说表现法律思想,律吕名义的释说中暗含了“德主刑辅”的政治布局,目的是劝谏周景王勤政爱民。这种举措是其所处社会的政治制度、文化背景、思想潮流驱动的必然结果。
The earliest record of twelve Chinese legal documents is “Mandarin”, the book recorded in the twelve law not only intact today, but also recognized by the legal profession, law books still use the twelve names. However, this traditional twelve law name is not formed at the time of the national language. Le Guanyingzhou Dove used the interpretation of the six principles to express the idea of “Respecting God and Protecting the People and Protecting the Citizens”, and expressed the legal thoughts with Liu Lu’s interpretation. Layout, the purpose is to persuade King Zhou Qin Aimin Zhou. Such measures are the inevitable result driven by the political system, cultural background and ideological trend of the society in which they live.
