道德与法律都有公、私之分。对道德作公、私的划分则为公德、私德。有人把公德等同于社会公德,其实公德与社会公德并不是同一概念,不应混用。对法律作公、私的划分则是公法和私法,很显然,公法也不是人们所理解的公共生活中的法律。因此,公德、私德与公法、私法中定语的“公”“、私”所指不同,不能简单地用公德直接对应公法,以私德直接对应私法。
Both morality and law are public and private. Public morality, private division is the morality, personal morality. Some people equate public morality with social morality. In fact, public morality and social morality are not the same concept and should not be mixed. Public law and private law are public and private law, it is clear that public law is not understood by people in public life law. Therefore, public morality, private morality and public law, private law attributive “public ”, “private ” refers to different, can not simply correspond directly with public law, public morality, private law directly corresponds to private law.
