在大数据时代,数据之于商业、监管等领域的意义固不待论。证券交易信息作为对投资者、交易所以及监管部门都具有重大意义的数据,在当今信息技术日益发达的社会背景下如何更好地被开发和利用,关系到证券市场的有效性及投资者的理性决策。随之而来的数据财产所有权定义、数据交易制度等新问题,也需要被深入探讨。为避免证券交易信息的滥用及无序传播、保护数据主体的收益权、深入挖掘数据的价值,可以从我国的相关法律依据及欧洲数据库保护理论的适用性入手,兼顾交易所、投资者和信息服务商等多方利益的诉求,遵循数据开发与流动的安全可控原则,构建数据交易制度,开展数据保护立法工作。
