在数字技术和互联网技术的迅速发展下,信息的复制和传播方式发生着巨大的变化,给著作权制度带来了新的挑战。面对互联网上的海量作品和使用者,传统的授权方式效率低下,交易成本过高,已不能满足网络环境作品的授权需要。在此背景下,本文以网络著作权的授权模式为切入点,对网络环境下著作权交易和运作及过程原理进行了研究。在分析具体的著作权授权模式时,本文以交易成本的控制为线索,对一系列新涌现的授权模式及集体管理组织和补偿金制度进行了阐述和分析,并提出了自己的思考和建议:通过数字权利管理技术的帮助,权利人和传播者可以建立起适合网络环境的授权交易机制并获得商业上的收益;技术革新在给著作权制度带来挑战的同时也在推动着著作权制度的发展,只有顺应技术潮流的选择才能最终获得成功。
With the rapid development of digital technology and Internet technology, there has been a tremendous change in the way information is copied and transmitted, posing new challenges to the copyright system. In the face of the massive works and users on the Internet, the traditional authorization methods are inefficient and the transaction costs are too high to meet the authorization needs of works in the network environment. Against this background, this dissertation takes the authorizing mode of network copyright as an entry point, and studies the transaction, operation and process of copyright under network environment. In the analysis of the specific model of copyright authorization, this paper cites the control of transaction costs as a clue, elaborates and analyzes a series of newly emerged authorization models and collective management organizations and compensation systems, and puts forward my own thoughts and suggestions: With the help of digital rights management technology, rights holders and communicators can establish authorized transaction mechanisms suitable for network environment and gain commercial benefits. Technological innovations have challenged the copyright system and promoted the development of the copyright system. Only the Conform to the choice of technology trends in the end to be successful.
