在法学本科课程刑法学的教学过程中,常常困扰教学者的一个问题是,究竟应当以何种犯罪论体系的逻辑思维进行课程讲授?教学者通常面临着需要对不同的犯罪论体系做出选择。之所以在刑法学的教学过程中要对不同的犯罪论体系做出选择,这应当也与犯罪论体系是否具有利于教学的功能相关。我国学者在论述犯罪论体系的功能时,基本上对其具有的教学功能鲜有论及。可以认为,犯罪论体系的选择既与法学本科教育的目的相关,也与犯罪论体系自身的理论逻辑相关。在目前我国刑法学知识转型的背景下,犯罪论体系基本体现为传统四要件体系的坚守与三阶层体系的突
One of the problems that plague pedagogues in the process of teaching law in criminal law undergraduate education is that what kind of system of criminal theory should be used to teach the course? Teaching is usually faced with the need to make a choice between different systems of crime . The reason why we should choose different criminal theory systems in the process of teaching of criminal law should also be related to whether the system of crime is conducive to teaching or not. When discussing the function of the crime theory system, our country’s scholars basically have little comment on its teaching function. It can be argued that the choice of crime system is not only related to the purpose of law undergraduate education, but also related to the theoretical logic of the crime theory itself. At present, under the background of knowledge transformation of criminal law in our country, the system of crime is basically reflected in the persistence of the traditional four-element system and the collapse of the three-tiered system
