现在是人格权利膨胀化的时代,传统的人身权和财产权已经无法满足现代的需要。环境人格权是一种社会性私权,它丰富的内容充分反映了时代的发展和社会的进步,也是环境保护的吁求在人格权法中的反映。民法中对环境人格权的保护,通过确认侵害环境人格权的行为为侵权行为,并采取传统民事救济手段和精神损害赔偿相结合,为权利被侵害人提供相应的法律救济。
Now is the era of the expansion of personality rights, the traditional personal rights and property rights have been unable to meet the needs of the present. Environmental personality right is a kind of social private right. Its rich content fully reflects the development of the times and the progress of society. It is also a reflection of environmental protection in personality right law. In the civil law, the protection of environmental right of personality is confirmed by the act of infringement of environmental right and the combination of traditional civil remedies and compensation for moral damage, so as to provide corresponding legal remedies for those who have been violated.
