我国公司法自颁布到经过修订之后的正式生效,在不断满足着我国市场经济发展的需求,但是任何法规的实施必不可少需要面对市场经济的风险以及适应市场经济的过程。本文通过现行公司法实施的重要意义出发,指出了制约其实施的因素和实际制约表现分析,并针对性的提出相应的完善机制,旨在促进公司法实施存在的最大化作用。
Since the promulgation of the Company Law of our country, the formal entry into force after the revision has continuously met the demand of the development of the market economy in our country. However, the implementation of any laws and regulations is indispensable to face the risks of the market economy and the process of adapting to the market economy. Based on the significance of the implementation of the current company law, this paper points out the factors restricting its implementation and the analysis of the actual performance constraints, and puts forward corresponding perfection mechanisms aimed at promoting the maximization of the existence of company law.
