                                高校校内学生申诉制度于2005年正式实施,教育部的规范性文件对其具有的规范功能予以初步阐述,即化解矛盾、维护权利及维持秩序。各高校根据教育部要求纷纷设立该项制度,但其规范功能在实践中的表现各有不同,体现为其功能是否实现、实现的程度以及该制度是否还发挥其他功能等方面。本文以北京市高校为研究样本,对上述实践情况予以描述、分析和总结,认为国家对高校进行行政规制的方式与程度、高校自治的程度等是影响高校校内学生申诉制度功能的重要因素。
The university student appeal system was formally implemented in 2005, and the normative documents of the Ministry of Education preliminarily elaborated its normative functions, that is, resolving conflicts, safeguarding rights and maintaining order. According to the requirements of the Ministry of Education, all colleges and universities have set up this system in succession, but their normative functions have different performance in practice, which is reflected in whether their functions are realized, their degree of realization and whether the system also plays other functions. This paper takes Beijing’s universities as a sample to describe, analyze and summarize the above practices. It holds that the way and extent of state regulation of colleges and universities and the degree of autonomy of colleges and universities are all important factors that affect the function of students’ appeal systems in colleges and universities.
