消费者选择标准和消费者福利是消费者标准的两大内容,但二者的内涵、外延和适用均不同。在非价格限制的案件中,使用消费者选择标准作为分析方法可以更加合理地解决此类案件的反垄断分析问题。在买方垄断滥用市场支配地位中,应当将消费者选择标准扩展至买方垄断。我国反垄断执法应当进一步对消费者选择标准、买方垄断等问题进行更加深入的研究和借鉴,不断提高反垄断案件处理结论的权威性。
Consumer selection criteria and consumer welfare are the two major contents of consumer standards, but their connotation, extension and application are different. In non-price-restricted cases, the use of consumer selection criteria as an analytical method can more appropriately address antitrust analysis issues in such cases. In the monopoly abuse of market dominance by buyers, consumer choice criteria should be extended to buyers monopolies. China’s antitrust law enforcement should further study and learn from consumer choice standards, buyer monopolies and other issues, and continuously improve the authority of handling antitrust cases.
