物权制度系西方文明自然演化的结果,其正当性来源于人格完整性。由于语境转换,具有伦理价值的物权概念在中国同时负载效用价值和伦理价值。基于二者内在的张力,在物权法中效用价值被置于优先地位。
Property system is the result of the natural evolution of Western civilization, its legitimacy comes from personality integrity. Due to the context change, the concept of real right with ethical value carries the utility value and ethical value in China at the same time.
