案情原告张静怡,出生于1999年1月。2007年9月,张静怡的父亲叶胜超和母亲张银梅协议离婚,协议约定张静怡由叶家抚养,张银梅不出抚养费。此后,张静怡一直与父亲叶胜超和奶奶陈中秋一起生活。2009年1月,叶胜超遇井下事故因工死亡。张银梅想让张静怡在自己的监护之下成长,但是张静怡及其奶奶陈中秋坚决不同意。2009年3月6日,张静怡以陈中秋为法定代理人起诉母亲张银梅,请求法院将其监护人由母亲张银梅变更为奶奶陈中秋。
The case plaintiff Zhang Jingyi, was born in January 1999. In September 2007, Zhang’s wife Ye Shengchao and his wife, Zhang Yinmei, agreed to divorce. According to the agreement, Zhang Jingyi was raised by Ye Jia and Zhang Yinmei did not provide any support. Since then, Zhang Jingyi has been living with his father, Ye Shengchao and his grandmother Chen Zhongqiu. January 2009, Ye Shengchao underground accident due to work died. Zhang Yinmei wants Zhang Jingyi to grow under his guardianship, but Zhang Jingyi and his grandmother Chen Zhongqiu strongly disagree. On March 6, 2009, Zhang Jingyi prosecuted her mother Zhang Yinmei with Chen Zhongqiu as the legal representative and requested the court to change her guardian from her mother, Zhang Yinmei, to her grandmother Chen Zhongqiu.
