随着我国民商法律体系的逐渐完善,人们逐渐重视起对《商法通则》立法理论的相关研究。而商法理念作为对于商法客观规律的理性认识和内在本质的根本观念,是我国调整商事立法和商事实践活动的具体表现,是商法对于追求商事生活实践活动终极目标的一种执着的理念与信仰。本文针对于商法理念对我国商事经济活动中的内涵和适用价值展开一系列讨论与分析。
With the gradual improvement of the legal system of civil and commercial in our country, people pay more attention to the related research on the legislative theory of “General Principles of Commercial Law”. The concept of commercial law, as the basic understanding of the objective law of commercial law and its inherent nature, is the concrete manifestation of China’s adjustment of commercial legislation and commercial practice. It is also a persistent belief and belief in the pursuit of the ultimate goal of commercial practice. In this paper, a series of discussions and analyzes are conducted on the connotation and applicable value of commercial law in China.
