国家赔偿的救济范围大小是全面考虑各种因素、对各种利益进行权衡后的客观结果。本文认为在拓展与规制中运用司法自由裁量权选择两者的平衡,在平衡中着重运用比例原则和诚实信用原则,以实现真实的平衡、实质的救济和国家赔偿的本质意义。
The size of the scope of remedies for state compensation is an objective result after a comprehensive consideration of various factors and weighing of various interests. This paper argues that in the process of expansion and regulation, the judicial discretion should be used to choose the balance between the two. In the balance, the principle of proportionality and honesty and credit should be used emphatically in order to achieve the true balance, substantive relief and the essential meaning of state compensation.
