本文通过文献资料法、问卷调查法、专家访谈法等方法对目前体育新闻侵权所依据的有关法律法规进行认真的研究与梳理,发现在处理体育新闻侵权的案件时,出现了处理体育新闻侵权的同案不同判、体育新闻侵权审判时无法可依,有法难依、把体育新闻舆论监督侵权视为一般体育名誉侵权和民事侵权行为、法院缺乏体育新闻侵权的立案标准、用司法解释来规范体育新闻侵权行为难以达到预期效果等现象弊端。呼吁国家尽快颁布体育新闻法。
