英美保险法上将合理期待原则作为解释保险合同的一项原则,目的在于保护投保人、被保险人或受益人对于保险条款内容的客观合理期待。该原则的适用不以保险双方对于条款理解存有疑义为必要,主要适用于普通消费者保险合同。在自动销售保单与邮寄销售保单的情形下,也有合理期待原则适用的必要性。
The Anglo-American Insurance Law regards the principle of reasonable expectation as a principle for explaining insurance contracts. The purpose is to protect the objective and reasonable expectations of policyholders, insureds or beneficiaries about the contents of insurance clauses. The application of this principle is not necessary for insurance parties to have doubts about the understanding of the terms and is mainly applicable to ordinary consumer insurance contracts. In the case of automatic sales policies and mail sales policies, there is also a need to reasonably expect the principles to apply.
