在行政立法过程中 ,从立法宗旨、立法原则、法律责任等方面都必须从人民的利益出发 ,以“三个代表”的思想指导行政法的立法工作。依法行政的实质是人民高于政府 ,政府是为人民服务的 ,法律是按人民的意志制定的。政府依法办事就是按人民意志办事。政府立法要体现行政公正、行政公开和行政效率的原则。政府行为只有公正 ,才能代表最广大人民的根本利益。行政立法中必须明确法律责任、建立监督机制 ,不受约束的权力必然产生腐败。
In the course of administrative legislation, we must proceed from the interests of the people, and guide the legislative work of administrative law from the thinking of the “three represents” in the legislative aims, legislative principles and legal responsibilities. The essence of administering according to law is that the people are above the government, the government serves the people, and the law is made according to the will of the people. The government acts in accordance with the law is based on the will of the people. Government legislation should reflect the principle of administrative justice, administrative openness and administrative efficiency. Only when the government conducts justice can it represent the fundamental interests of the overwhelming majority of the people. In the administrative legislation, we must clarify the legal responsibilities and establish a supervisory mechanism. Unfettered power will inevitably lead to corruption.
