驰名商标反淡化保护是指不仅禁止他人将驰名商标使用于相同或类似的商品或服务上,而且禁止他人将驰名商标使用于不同或不类似的商品或服务上。本文认为只要符合驰名商标的认定标准,就应当给予相应的反淡化保护,而不应仅仅局限于注册的驰名商标。通过研究我国的驰名商标反淡化保护立法和企业等对驰名商标积极维护的程度,可以发现我国驰名商标反淡化保护的诸多不足之处,因此有必要提出若干完善建议。
Well-known trademark anti-dilutive protection refers not only to prohibit the use of well-known trademarks on the same or similar goods or services, but also prohibits the use of well-known trademarks on different or dissimilar goods or services. This paper argues that as long as the accreditation standards of well-known trademarks are met, it should be given corresponding anti-dilution protection instead of confined to registered well-known trademarks. By studying China’s well-known trademark anti-dilution protection legislation and enterprises and other well-known trademarks on the level of the active protection, we can find our country well-known trademarks anti-dilution protection of many deficiencies, it is necessary to make a number of sound suggestions.
