事后受贿是基本受贿罪的一种变体,其在客观上通常表现为国家工作人员利用职务之便为他人实际谋取到利益后,索取或者收受他人财物的行为。但考虑到司法实践的复杂性,我们不仅需要对这种在职的事后受贿作出正确的界定,还需要对那些国家工作人员离职后的事后受贿行为作出界定。本文先从解释论的角度,阐述了事后受贿的定罪与受贿罪的法益的关系,接着探讨了“利用职务之便”、“为他人谋取利益”等客观要件和主观要件的认定,最后在考察主体要件时得出由于此要件的缺失,在我国现行刑法下无法认定离职后的事后受贿构成犯罪的结论。于是笔者便从立法论的角度,运用比较分析的方法,借鉴国外先进的立法例,尤其是参照了日本刑法典关于事后受贿罪的规定,指出我国《刑法》第385条受贿罪的规定应当修改并给出了修改意见,即应增设385条之一:曾为国家工作人员的人,离职前利用职务上的便利,为他人谋取利益,离职后索取或者非法收受他人财物的,以受贿论处。
Subsequent bribery is a variant of the basic bribery, which is objectively manifested in the acts of soliciting or accepting the property of other people after the national staff take advantage of their positions to actually seek benefits for others. However, taking into account the complexity of judicial practice, we not only need to correctly define such post-employment bribery on the job, but also define the after-service bribery behavior of those national staff members. From the angle of interpretation theory, this article elaborates the relationship between the conviction of bribery and the legal interest of taking bribes, and then discusses the determination of objective and subjective elements such as “using his position ” and “seeking benefits for others ” At the end of the investigation, the author concludes that due to the absence of this requirement, the bribery after leaving China that can not be determined after the departure under the current criminal law in our country constitutes a crime conclusion. So I from the legislative point of view, the use of comparative analysis of methods, learn from advanced foreign legislation, especially with reference to the Japanese Penal Code on the provisions of the bribery after the incident, that the “Criminal Law” Article 385 of the provisions of the crime of accepting bribes should be modified The article also proposes the following suggestions: 385 persons should be added: those who used to be national staffs, taking advantage of their position before leaving employment, seeking benefits for others, claiming after taking over or illegally accepting the property of others, shall be subject to bribery.
