签订合同,是实行农业经济合同制的首要环节。合同签订的好与坏,直接关系到合同是否能够得到顺利履行。签订农业经济合同必须遵循以下三项原则:1.平等互利的原则。合同双方当事人平等地享有经济权利和承担经济义务,双方的法律地位平等,经济交往是互利的。这就要求合同的内容必须公平合理,不允许损害对方的经济利益。违背了这一原则,合同管理机关和人民法院有权仲裁,宣布合同全部或部分无效。
The signing of the contract is the primary link in the implementation of the agricultural economic contract system. The contract is good or bad, is directly related to whether the contract can be successfully implemented. The signing of agricultural economic contract must follow the following three principles: 1. The principle of equality and mutual benefit. The parties to the contract enjoy the economic rights and undertake the economic obligations on an equal basis. Both parties enjoy equal legal status and economic contacts are mutually beneficial. This requires that the contents of the contract must be fair and reasonable, and not to the detriment of each other's economic interests. Contrary to this principle, the contract management authority and the people's court have the power to arbitrate and declare the contract null and void in whole or in part.
