虽然WTO争端解决机制加强了对发展中国家的保护,但发展中国家对该机制运用在整体上是落后与被动的,我国的情况更是如此。巴西、印度、墨西哥等发展中大国在这方面已远远走在我国前面。作为WTO的新成员,如何利用WTO争端解决机制维护我国的经济利益,是我们面临的重大挑战。我国应当借鉴其成功经验。完善参与该机制的管理机制,积极而有成效地利用好这一机制,力挽被诉方面防守乏力却诉案日增,投诉方面白白葬送大量良好机会的困局。
Although the WTO dispute settlement mechanism has strengthened the protection of developing countries, the developing countries’ use of the mechanism as a whole is backward and passive. This is especially the case in our country. The developing countries such as Brazil, India and Mexico have gone far ahead of our country in this respect. As a new member of the WTO, how to use the WTO dispute settlement mechanism to safeguard China’s economic interests is a major challenge we face. Our country should learn from its successful experience. Improve the management mechanism for participating in the mechanism, actively and effectively make good use of this mechanism, and strive to ease the defendants’ indignities but increase the number of prosecutions. The complaints have plagued numerous dilemmas of good opportunities.
