一、基本情况2013年,国家工商总局商标评审委员会(简称“商评委”)裁决商标评审案件14.42万件,当事人不服裁决,向北京市第一中级人民法院提起行政诉讼的案件计1760件,与2012年的2525件相比下降了30%,占商标评审案件裁决数量的1.22%,与往年约4%的起诉率相比下降较大;进入北京市高级人民法院二审程序的商标评审案件有881件;进入最高人民法院再审听证程序或再审程序的案件有57件。2013
I. Basic Information In 2013, the Trademark Review and Adjudication Board of the State Administration for Industry and Commerce (the “TRAB”) ruled 144,200 trademark adjudication cases. The parties refuse to accept the verdicts and 1,760 cases of administrative proceedings against the First Intermediate People’s Court of Beijing , Down 30% from 2525 cases in 2012, accounting for 1.22% of the total number of trademark adjudication cases. Compared with the rate of 4% in previous years, the rate of prosecution dropped significantly. The trademark trial cases entering the Second Instance of Beijing Higher People’s Court There were 881 cases; 57 cases entered the hearing procedure or retrial procedure of the Supreme People’s Court. 2013
