在电子商务蓬勃发展的今天,网络活动产生的纠纷也日益增多,而管辖权作为法院必须首先解决的问题,其本身也被打上了网络空间的烙印。在电子商务环境下的B2C合同管辖权领域,各国都在探索适当的管辖权模式,以达到兼顾消费者保护和促进网络经济发展的目的。本文主要从国际私法角度对B2C合同的管辖权问题进行探讨,展现电子商务发展相对成熟的国家和地区在这一领域的立场和实践的前沿动态,深入分析欧盟的立法和美国的相关案例,通过分析比较,结合我国在实践中的做法提出建议,以期对我国在网络经济时代的电子商务经济的发展和相关的司法实践能够有所裨益。
In the thriving e-commerce today, there are more and more disputes arising from internet activities. As a matter that the court must first solve, jurisdiction itself has also been marked by the cyber space. In the field of B2C contractual jurisdiction in the e-commerce environment, all countries are exploring appropriate modes of jurisdiction in order to achieve consumer protection and promote the development of the network economy. This article mainly from the perspective of private international law B2C contract jurisdiction issues to explore the development of e-commerce is relatively mature countries and regions in this area, the position and practice of the forefront of developments in-depth analysis of EU legislation and the United States related cases through Analysis and comparison, combined with China’s practice in practice to make recommendations to our country in the era of network economy, the development of e-commerce economy and related judicial practice can be beneficial.
