制度环境对债权人利益保护有着深刻的影响,债权人利益保护失效存在着深刻的制度原因,本文从产权、文化、政府三个方面剖析了这一制度环境。在此基础上本文提出了制度安排的改进建议。
The institutional environment has a profound impact on the protection of creditors’ interests. There are profound institutional reasons for the failure of the creditor’s protection of interests. This paper analyzes the institutional environment from three aspects: property rights, culture and government. On this basis, this paper puts forward suggestions for improving institutional arrangements.
