近年来,全球各知名品牌投入较大的经济成本打击我国商品交易市场侵犯知识产权的行为,但知识产权侵权行为仍然未能得到有效的控制。在这种形势下,权利人采取了新的维权策略,扩大了打击对象的范围,即不仅将目光盯在直接销售侵权产品的经营者,而且将矛头同时对准了商品交易市场的管理者——市场管理者。目前,虽然北京、上海等地法院均有对市场管理者在知识产权领域侵权责任的判例,但由于市场管理者的权利义务在现有法律体系中缺乏明确界定,其侵权责任的认定及承担仍然需要进一步明确。基于此,本文将通过探讨市场管理者知识产权侵权责任的认定及承担,分析市场管理者可能面临的法律风险,进而提出市场管理的应对策略。
