[案情简介]申请人:林某某。被告:某矿务局多种经营公司。原告诉称:原告于1998年6月13日,在被告处井下采煤时受伤。2004年8月25日被认定为工伤。2004年12月15日经市劳动能力鉴定委员会鉴定为五级伤残。双方就工伤待遇问题诉讼后,判决被告自2008年10月开始每月向原告支付伤残津贴400元至今,已远低于当地最低工资标准。现原告再次向法院提起诉讼,要求解除双方劳动关系,并要求被告给付一次性
[Case Profile] Applicant: Lin Moumou. Defendant: a mining company diversified company. The plaintiff claimed that: On June 13, 1998, the plaintiff was injured while mining the mine at the defendant. August 25, 2004 was identified as work-related injuries. December 15, 2004 by the municipal labor capacity appraisal committee identified as five disability. After the two parties litigated the issue of work-related injury treatment, the defendant was sentenced to paying the disability allowance of 400 yuan per month to the plaintiff since October 2008, far below the local minimum wage.
