随着民营经济在拉动经济增长、促进就业等方面起到越来越重要的作用,优化制度环境显得愈加重要。十届全国人大二次会议审议通过的宪法修正案,根据我国的现实情况,对现行宪法有关保护私有财产的规定作了重要修改,进一步明确规定:“公民的合法的私有财产不受侵犯。”“国家依照法律规定保护公民的私有对产权和继承权。”“国家为了公共利益的需要,可以依照法律规定对公民的私有财产实行征收或者征用并给予补偿。”这次修宪无疑是促进民营经济蓬勃发展的催化剂。优化制度环境,首先要改变区别所有制性质给予不同待遇的观念和做法,放宽市场准入,保障民企在投融资、税收、土地使用和对外贸易等方面,与其他所有制企业享受同等待遇。政府应严格遵守宪法规定,切实保护好私有财产权,保护民企的合法权益和民营企业家的合法收入,不能剥夺、侵犯其合法财产。《行政许可法》已发布实施,政府应以此为契机,健全行政服务体系,
With the private economy playing an increasingly important role in driving economic growth and promoting employment, it is even more important to optimize the institutional environment. The amendment to the Constitution passed at the Second Session of the Tenth National People’s Congress made an important amendment to the existing constitutional provisions on the protection of private property in light of the actual conditions in our country and further stipulated: “The lawful private property of citizens shall not be infringed upon. In accordance with the law, the state protects the private property rights and inheritance rights of citizens. ”“ For the public interest, the state may impose or requisition and compensate private citizens for property in accordance with the law. ” Constitution is undoubtedly the catalyst to promote the vigorous development of private economy. In order to optimize the institutional environment, we must first change the concept and practice of giving different treatment depending on the nature of ownership and relax market access to ensure that private enterprises enjoy equal treatment with other ownership-based enterprises in terms of investment and financing, taxation, land use and foreign trade. The government should strictly abide by the provisions of the Constitution, effectively protect the private property rights, protect the legitimate rights and interests of private enterprises and the legitimate income of private entrepreneurs, can not be deprived of their legitimate property.
