什么是企业法律顾问? 企业法律顾问在西方国家称为“公司法律顾问”,或“内部顾问”,在欧洲叫做“公司律师”,它出现在十九世纪末年。1882年美国新泽西州在历史上第一个设立了法律事务部,随着商品、资本、技术和人员输出以及跨国公司的发展,公司规模日益扩大,业务日趋复杂,涉及到的法律问题越来越多,律师事务所已不能完全满足需要,于是各大银行、大企业、大公司就聘请律师充当顾问组成法律部,现在公司法律顾问正起着越来越重要的作用,法律顾问专门处理公司内外法律事务,维护公司财产和其他合法权益。我国最早设立法律顾问机构的是中国国际贸易促进委员会的法律顾问处,武汉钢铁公司的法律顾问处,律师担任企业法律顾问工作是近二年来从上海、北京兴办起来的。所谓企业法律顾问,就是企业因开展对外经济活动和加强经济法制管理的需要,根据《中华人民共和国律师暂行条例》的有关规定,同律师执行职务的工作机构的律师事务所签订聘请常年法律顾问合同,由律师事务所派出律师担任该企业的法律顾问,提供法律帮助,办理有关法律事务,维护企业的合法权益。
