正如程永顺主任所说,我们没有把商标是什么搞清楚。驰名商标原本是商标的一种。在新出台的《解释》中,对驰名商标的定义中没有提到声誉、美誉,就在于商标的功能只是区别作用,和声誉、美誉没有直接联系。
