“两高”在全国人大的授权下开展了刑事速裁程序的改革探索。本次改革应着眼侦查阶段的程序简化、检察机关办案机构的革新,推动轻微刑事案件的书面审,完善刑事速裁程序的证据制度,进一步保障犯罪嫌疑人、被告人的合法权益。通过对刑事速裁程序运行状况进行抽样调查研究,笔者认为,应该通过探索部分轻微刑事案件“拘留——审判”的诉讼模式、深化主任检察官制度、推行略式审判书面审、给予被告人减刑激励等方式,完善刑事速裁程序。 Under the authorization of the NPC, the “two highs” have carried out the reform exploration on the criminal speed arbitration proceedings. This reform should focus on the simplification of procedures during the investigation stage, the reform of the case handling organs of prosecutors, the promotion of written trial of minor criminal cases, the improvement of the evidence system of criminal speed-arbitration proceedings and the further safeguard of the lawful rights and interests of criminal suspects and defendants. Through the sample investigation of the operation of the speed-punishments in criminal cases, the author believes that we should deepen the system of chief prosecutors by exploring some litigation models of minor criminal cases such as “detention-trial” Commutation of incentives and other means to improve the speed of criminal proceedings proceedings.
