民间文学艺术是国家珍贵的文化遗产,然而,随着现代社会经济的快速发展和文化的不断交流,许多优秀的民间文学艺术作品被不正当地加以利用,甚至是遭到了不可恢复的严重破坏。因此,加强对民间文学艺术的管理与保护已经成为我国目前亟需重视的一项工作。本文从基本概念出发,介绍了我国民间文学艺术面临的主要困境和现有版权保护机制的不健全性,并对完善民间文学艺术的法律保护提出了几点合理建议。
However, with the rapid economic development in the modern society and the constant exchange of culture, many excellent works of folk literature and art have been illegally used or even severely damaged by irreversibility. Folk literature and art are precious cultural heritage of the country. Therefore, strengthening the management and protection of folklore has become an urgent task for our country. Based on the basic concepts, this paper introduces the main dilemmas faced by folk literature and art in our country and the unsoundness of the existing copyright protection mechanisms, and puts forward some reasonable suggestions on how to improve the legal protection of folk literature and art.
