讯问职务犯罪嫌疑人实施全程同步录音录像制度,是检察机关顺应国际先进执法理念,适应国内法治建设发展进程,加强自身建设、推进检察体制改革、完善法律监督制度、实现司法公正的一项重大举措。该制度对于防止刑讯逼供,保障公民合法权益无疑具有积极的意义。然而遗憾的是,在实践中,这项制度却经常被异化成侦查机关刑讯逼供的挡风墙,只有找出根源,才能对症下药。因此反思这一病态现象的成因,对于完善录音录像制度无疑具有重大意义。
To interrogate the criminal suspect in charge of the whole job to implement the system of simultaneous audio and video recording is a major move by the procuratorial organs to comply with the international advanced law enforcement concepts, to adapt to the development of the rule of law in China, to strengthen self-construction, to promote the procuratorial system reform, to improve the legal supervision system, and to realize judicial fairness . This system undoubtedly has positive significance for preventing confession by torture and safeguarding the legitimate rights and interests of citizens. Regrettably, however, in practice this system has often been alienated as a wind wall forcing confessions by the investigating authorities. Only by finding the root causes can the remedy be prescribed. Therefore, to reflect on the causes of this morbid phenomenon is undoubtedly of great significance for improving the audio-video recording system.
