职务犯罪案件属于人民检察院直接受理、侦查的案件,该类案件与普通刑事案件相比具有不同特点。我国《刑事诉讼法》规定的五种强制措施在职务犯罪案件侦查中存在适用条件缺乏统一标准;强制措施的决定权和执行权相脱节;强制措施的期限存在一定的漏洞等问题。应在立法上对相关未完善的问题予以明确,改变不合理的规定,同时为使强制措施的使用在职务犯罪侦查案件中发挥最大的功效,应对相关的侦查手段予以完善。
The duty crimes belong to the cases directly investigated and investigated by the People’s Procuratorate, which have different characteristics compared with ordinary criminal cases. The five kinds of coercive measures stipulated in the “Criminal Procedure Law” of our country lacks uniform standards in the investigation of job-related crimes; the decision-making powers and enforcement powers of coercive measures are out of line; the duration of coercive measures has certain loopholes and other issues. At the same time, in order to make the use of compulsory measures play the most effective role in the investigation of duty crimes, we should improve the relevant means of investigation by clarifying the imperfect issues in the legislation and changing the unreasonable ones.
