在全球化和商品经济高度发展的大背景下,我国传统文化的知识产权正处在丢失和被边缘化的危险境地之中。本文以民间文学艺术为视角,结合我国对民间文学艺术的保护现状,要完善我国著作权立法,通过著作权模式和商标权模式结合保护民间文学艺术,并设立独立的商品化权才能更加完善地保护我国民间文学艺术的知识产权,进而更好的保护我国传统文化的知识产权。
Under the background of the globalization and the highly developed commodity economy, the intellectual property of our traditional culture is in danger of being lost and marginalized. In this paper, from the perspective of folklore, combined with our country's status quo on the protection of folklore, it is necessary to improve China's copyright legislation, through the combination of copyright and trademark rights to protect folklore, and to establish an independent right to commercialize in order to better protect our country Folk literature and art of intellectual property rights, and thus better protection of our traditional culture of intellectual property.
