顾客在就餐过程中物品被盗,经常会要求餐饮企业赔偿。餐饮企业与顾客之间的法律关系与责任,究竟应该适用保管合同、消费者权益保护法、消费合同的附属义务还是特殊侵权责任,司法实务没有形成统一的意见。侵权法出台后没有发现最新适用侵权法的案例。一般情况下,餐饮企业只要履行了提示、警告义务,就没有赔偿责任。如果没有履行,行政司法部门可能会要求餐饮企业赔偿顾客的部分损失。
