随着我国劳务派遣业的快速发展,派遣工权益的保障问题受到更多关注。在健康风险日趋多元、工伤事故大量存在的当下,处于劳务派遣特殊法律结构中的派遣工的健康权应得到重视和保护。梳理劳务派遣基本法律关系,明确健康权的概念与内涵,呈展我国派遣工健康权保障状况。在此基础上,浅探我国现行法律框架下对被派遣劳动者健康权的维护,总结其制度亮点,指出存在的缺角,并提出相关的完善建议。
With the rapid development of the labor dispatch industry in our country, more attention has been paid to the protection of dispatched workers' rights and interests. At a time when the health risks are becoming increasingly diversified and there is a large number of industrial accidents, the right to health of dispatched workers in special legal structures for labor dispatch should be valued and protected. Sort out the basic legal relations of labor dispatch, clarify the concept and connotation of the right to health, and present the status quo of safeguarding the right to health of dispatched workers in our country. On this basis, this paper probes into the maintenance of the right to health of the workers dispatched under the current legal framework in our country, summarizes the highlights of the system, points out the existing shortcomings and puts forward relevant suggestions for improvement.
