所谓争议行为系指劳资争议当事人为达成其主张,所为之罢工或其他阻碍事业正常运作及与之对抗之行为。因而,设置纠察线行为并非罢工行为本身,而可归类于劳资争议行为之一种。工会罢工时,如有设置纠察线,仍应另外认定设置纠察线是否符合于要件。以美国法之经验,合法纠察线设置与抵制行为之要件,仍需符于不违反集体劳动法对主体、目的、手段与程序之禁止规定。不应限于罢工时才可以合法设置罢工纠察线。
The so-called controversial behavior refers to the labor dispute in order to reach its claim, the strike or other activities impede the normal operation and confrontation behavior. Therefore, the act of setting up a picket line is not a strike itself but can be classified as one of the types of labor dispute. When a union strike is set up, if a picketing line is set up, it should still be otherwise determined whether setting up a picketing line meets the requirements. With the experience of the United States law, the elements of setting up a legitimate picket line and boycotting behavior still need to be consistent with the prohibition provisions of the collective labor law on subjects, purposes, means and procedures. Strike picketing should not be legally set to strike.
