随着科学技术、社会生产力的快速发展,由环境污染和环境破坏所引起的环境侵权现象时有发生,环境侵权问题越来越受到人们的关注。环境侵权不同于传统侵权行为,其特征乃是环境侵权迥异于传统侵权行为的内在根基。鉴于目前我国对环境侵权的立法尚不完备,本文针对我国当前的环境侵权问题及立法现状,通过分析和探究环境侵权的特征,从而界定环境侵权责任的基本构成。
With the rapid development of science and technology and social productive forces, the phenomenon of environmental tort caused by environmental pollution and environmental destruction often occurs, and the issue of environmental tort has drawn more and more attention. Environmental infringement is different from the traditional infringement, which is characterized by the fact that environmental infringement is very different from the inherent foundation of traditional infringement. In view of the incomplete legislation of environmental infringement in our country at present, this paper aims at the current situation of environmental infringement and the status quo of legislation in our country. By analyzing and investigating the characteristics of environmental infringement, this paper defines the basic constitution of environmental tort liability.
